Terms and Conditions

General Terms and Conditions Amanda Beauty GmbH and Amanda Nails GmbH (hereinafter referred to as AB/AN)

 

General

1. The following Terms and Conditions are part of the contracts concluded between AB/AN and its customers.

2. By placing the order, the buyer explicitly agrees to these Terms and Conditions.

3. The Terms and Conditions also apply to all subsequent transactions without needing to be expressly mentioned or agreed upon again at their conclusion.

4. All offers are non-binding. Errors and printing mistakes excepted.

 

Prices

1. All prices are ex-warehouse and are stated in Swiss francs plus packaging/shipping costs and the statutory VAT valid at the time of fulfillment.

2. Price changes due to changing market conditions are reserved.

Payment Terms

1. The purchase price is due immediately upon ordering. The buyer can pay the purchase price in advance or via PayPal.

 

Packaging/Shipping costs

1. Packaging and shipping costs are a flat rate of CHF 9.50. For orders over CHF 290.00 in merchandise value, we deliver free of charge. Delivery costs from Mobiliar are charged based on actual costs, not as a flat rate.

 

Purchase on account with installment payment option (POWERPAY)

MF Group / POWERPAY offers the payment method “Purchase on Account” as an external payment service provider. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will receive a monthly invoice with an order overview the following month.

When concluding the purchase contract, POWERPAY takes over the resulting invoice claim and handles the corresponding payment arrangements. When purchasing on account, you accept in addition to our Terms and Conditions,
the Terms and Conditions of POWERPAY. (powerpay.ch/de/agb).

You will receive the invoice free of charge by email. A valid email address is required.

 

Delivery

1. Acceptance of the order is subject to availability. The buyer also accepts partial deliveries.

2. The shipment of goods is exclusively at the buyer's risk.

3. Claims for damages, rights of withdrawal, or similar may also arise from lost or damaged goods as well as timing issues.

Delays cannot be claimed against the sender.

4. Transport damages must be reported immediately to the carrier and AB/AN.

5. Shipping of goods takes place from Monday to Friday (except on holidays) via A-Post. (Subject to stock availability)

 

Right to Amend

1. The descriptions and/or images of the goods are merely non-binding product descriptions and do not constitute a guarantee of properties. AB/AN assumes no liability for commercially customary and reasonable deviations of the goods from the catalog/online shop.

2. Commercially customary and reasonable color deviations in goods with color mixtures are reserved.

 

Retention of title

1. The goods remain the property of AB/AN until full payment of the purchase price has been made.

 

Right of Withdrawal

1. AB/AN has the right to withdraw from the contract if the manufacturer of the ordered goods has discontinued production or in cases of force majeure, provided these circumstances occurred only after the contract was concluded. The customer must be notified immediately.

 

Right of return

1. Ordered and properly delivered goods can only be returned within 10 days of delivery if they are in the original packaging, unopened, and unused. The costs of return shipping are borne by the buyer. If the goods are returned incomplete, not in the original packaging, in packaging that is not flawless and saleable, or damaged, AB/AN is entitled to claim compensation from the buyer for the reduction in value. The right of return does not apply to damages for which the customer is responsible. All Corona protection items are excluded from the right of return.

 

Exclusion

1. AB/AN reserves the right to exclude customers who have not paid for the ordered goods within the granted payment period from further deliveries.

 

Data Protection

1. The data necessary for order processing is stored and used within the scope of order processing. All personal data is, of course, treated confidentially. The personal details of an order are transmitted via SSL encryption.

 

Liability

1. AB/AN excludes any liability towards the customer within the legally permissible scope.

 

Applicable Law, Jurisdiction

1. The legal relationships are subject to Swiss law. The exclusive place of jurisdiction for both parties is Zurich.

 

Severability Clause

1. The possible invalidity of individual provisions of these general terms and conditions does not affect the validity of the remaining provisions.

These General Terms and Conditions invalidate all previous General Terms and Conditions as well as catalogs and price lists.

General Course Conditions of Amanda Beauty GmbH Academy

 

Registration

Every registration is binding. Oral or written registration obliges you to pay the course fee. Non-payment of the course fee does not count as cancellation.

 

Cancellation/Withdrawal

Cancellations and/or rescheduling received up to 4 weeks before the course start will be charged a fee of 15% of the course fees.

If cancellation and/or rescheduling is not made at least four weeks before the course start, the full course fees are payable.

Missed or skipped course days, course interruptions, or no-shows do not entitle a price reduction and/or refund of the course fee and cannot be made up. Absence from course days does not exempt payment of the course fees. If the course fees are not paid, Amanda Beauty GmbH has the right to cancel your course place at short notice. The full course fees must still be paid in full.

 

Certificate

After completing the training, each participant receives a certificate.

 

Models

Course participants are responsible for organizing models for practical work themselves. The absence of a model does not entitle cancellation or rescheduling of the course.

 

Changes

We reserve the right to make general changes as well as price changes. Amanda Beauty GmbH may also reschedule or cancel courses.

 

Copyright

All correspondence and course materials provided are intended for the personal use of the course participants only.

Any partial or complete reproduction, duplication, or copying is prohibited. All documents remain the intellectual property of Amanda Beauty GmbH.

 

Place of Jurisdiction

The exclusive place of jurisdiction for both parties is Zurich.

 

Validity

These General Course Conditions apply from 01.01.2023.

All previous General Course Conditions are superseded by these.

Their validity. By registering for the course, the participant acknowledges these General Course Conditions.
